Terms of Use

1. General Provisions

These Terms of Use (“Terms”) govern your use of the Hugami mobile application (the “Application”) provided by TON4STUDIO LLC (“Company”, “we”, “us”). By installing or using the Application, you (“User”, “you”) confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not install or use the Application.

The Application is available worldwide. You must comply with all laws applicable to you. If you are under 13 years old (or the minimum age of digital consent in your jurisdiction), you must not use the Application unless your parent or legal guardian has reviewed and agreed to these Terms and supervises your use.

We may refuse, restrict, suspend, or terminate access to the Application for any violation of these Terms, as described below.

2. User Rights and Responsibilities

2.1 User Rights

  • Use the Application’s features (including uploading images and receiving generated text) in accordance with these Terms.
  • You retain ownership of the text generated for you and the images you upload. We do not claim ownership over your uploads or your final generated text.
  • Stop using the Application at any time; if you do, please delete it from your device.

2.2 User Responsibilities

  • Use the Application only for lawful purposes and in compliance with these Terms and applicable laws.
  • Provide accurate, current information where required (e.g., for subscriptions).
  • Keep your account credentials confidential and accept responsibility for all activity under your account.
  • Upload only content you have the rights and permissions to use within the Application.
  • Pay any charges from your internet/data provider.
  • Pay for subscription services on time (see Section 4).

Failure to comply may result in suspension or termination of access.

3. Restrictions and Prohibited Content

Users are prohibited from:

  • Uploading or generating illegal content (including child sexual abuse material, hate speech, extremist or terrorist content, or other unlawful materials).
  • Infringing third-party rights (privacy, intellectual property, publicity) or violating others’ data protection rights.
  • Engaging in abusive, threatening, harassing, or discriminatory behavior.
  • Uploading images or data about third parties without their lawful consent.
  • Interfering with the Application, introducing malware, scraping, overloading infrastructure, or bypassing security/usage limits.
  • Using the Application for purposes other than its intended functionality.

We may remove content, restrict features, or suspend/terminate access if violations are detected.

4. Subscription and Payment

  • The Application offers paid, subscription-based features.
  • Subscriptions are processed by third-party platforms such as the Apple App Store and Google Play.
  • Payments are charged in advance for each billing cycle and renew automatically unless canceled before the next period.
  • Prices, taxes, and refunds are handled under the applicable app store’s terms and your local tax rules.
  • Failure to pay may lead to suspension or cancellation of your subscription.

5. Cancellation and Refunds

  • You may cancel at any time via your app store account settings.
  • Deleting the Application does not cancel your subscription.
  • Refunds are generally not provided except as required by law or applicable app store policies.
  • If we discontinue the Application, we may (at our discretion) provide refunds for unused periods where required by law.

6. Intellectual Property

  • The Application, its software, UI, trademarks, and all content (other than user-generated content) are owned by the Company or its licensors and are protected by applicable laws.
  • You retain rights to your generated text and uploaded images.
  • You must not reverse engineer, decompile, modify, or copy the Application’s code, nor create derivative works, except to the extent such restrictions are prohibited by law.

7. Disclaimers and Limitation of Liability

  • The Application is provided “AS IS” and “AS AVAILABLE” without warranties of any kind (express or implied), including fitness for a particular purpose, accuracy, or non-infringement.
  • We do not warrant uninterrupted or error-free operation, nor the accuracy or appropriateness of generated text. You are responsible for reviewing outputs before use.
  • We are not responsible for user-generated content.
  • To the maximum extent permitted by law, our aggregate liability for all claims related to the Application will not exceed the greater of USD $100 or the amount you paid to us for the Application in the 12 months preceding the claim.

8. Changes to Terms

We may update these Terms from time to time. Where required, we will notify you (e.g., in-app notice or email). Continued use after changes become effective constitutes acceptance of the updated Terms.

9. Governing Law and Disputes

  • These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules.
  • All disputes will be subject to the exclusive jurisdiction and venue of the state or federal courts located in New Castle County, Delaware, USA, unless a different forum is mandated by applicable consumer protection law.
